Freight Forwarders Take Shipping Lines to Court Over Unapproved Port Charges

The Ghana Institute of Freight Forwarders (GIFF) has filed a lawsuit against the Ship Owners and Agents Association of Ghana (SOAAG) and several affiliated shipping agencies, accusing them of introducing unauthorised charges that have significantly increased the cost of doing business at the ports.

The Allegations


According to the GIFF, these agencies have been levying unapproved fees, including:


  • Container administrative fees

  • Processing fees

  • Evacuation fees

  • Container washing fees

  • Demurrage fees


In a writ filed on January 20, 2025, the GIFF asserts that these charges are not only unjustified but also violate directives issued by the Ghana Shippers Authority to halt the imposition of extra port fees.


The Reliefs Sought


The Freight Forwarders are seeking multiple court orders, including:


  1. A declaration that imposing unapproved charges is illegal.

  2. A ruling that counting weekends and public holidays as part of demurrage calculations is unlawful.

  3. A refund of all monies collected through these disputed charges.

  4. Compensation for costs, including legal fees.

  5. Any additional relief deemed appropriate by the court.

The GIFF describes this legal action as a necessary move to protect port users and ensure compliance with industry standards and regulations. They argue that these unwarranted charges harm businesses, disrupt trade, and place undue financial burdens on customers.
