In a landmark ruling, the Supreme Court has affirmed the re-collated parliamentary election results for Nsawam Adoagyiri and Ahafo Ano North, validating the Electoral Commission's (EC) declarations for these constituencies. The decision comes amidst contentious legal challenges regarding the fairness and legality of the re-collation process in other areas.

The Supreme Court set aside the re-collated results for Okaikwei Central, Ablekuma North, Tema Central, and Techiman South, citing procedural flaws and irregularities. Presiding Justice Gabriel Pwamang underscored the distinct legal status of Nsawam Adoagyiri and Ahafo Ano North, affirming that the EC’s actions in these constituencies complied with legal standards.
“Accordingly, the collation of results in the above constituencies by the EC after 20th December 2024 on the orders of the court are hereby set aside. For the avoidance of doubt, the orders of the court made in respect of Nsawam Adoagyiri and Ahafo Ano North are not affected by this our order, and in effect, those declarations stand.”
The annulled results were part of a broader challenge by the National Democratic Congress (NDC), which argued that the re-collation process violated principles of natural justice. The NDC claimed that their candidates were not properly notified or heard before the re-collation orders were issued by the High Court.
Baba Sadiq, the NDC parliamentary candidate for Okaikwei Central, welcomed the Supreme Court’s decision, calling it a triumph for democracy and the will of the people. He reassured his constituents that the fight for electoral transparency and fairness would continue.
“This ruling is a vindication of our stance and a testament to the resilience of the democratic process. We will persist in ensuring that the people’s voice is respected,” Baba Sadiq stated.
The Supreme Court’s ruling has significant ramifications for Ghana’s electoral system. It underscores the judiciary’s pivotal role in upholding both electoral integrity and procedural fairness. Observers believe this decision sets a precedent for how re-collation orders and disputes involving the EC will be addressed in the future.
Additionally, the case highlights the importance of judicial oversight in safeguarding democratic processes and ensuring that all parties are granted fair hearings in electoral disputes.
As Ghana continues to strengthen its democratic institutions, this ruling serves as a benchmark for balancing the enforcement of electoral laws with the protection of natural justice. It also raises questions about how the EC and political parties will navigate similar disputes in future elections.
